Dizire Novel Engine Terms of Service

1. Agreement

Welcome to Dizire Novel Engine ("Dizire", "Service", or "Platform"), a software platform owned and operated by AI Skunkworks, LLC ("Company", "we", "our", or "us").

By creating an account, accessing, or using Dizire Novel Engine, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

If you are entering into this agreement on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Description of Services

Dizire Novel Engine is a software-as-a-service platform that may provide:

Novel writing tools
Story planning and outlining
Character management
World-building tools
Mind mapping
Manuscript organization
AI-assisted writing features
Publishing preparation tools
Export capabilities
Collaboration features
Other related services

We reserve the right to modify, add, remove, or discontinue features at any time.

3. Eligibility

You must be at least eighteen (18) years old to create an account or use the Service.

By using the Service, you represent and warrant that:

You are at least eighteen years old.
You can legally enter into a binding agreement.
Your use complies with applicable laws and regulations.

4. Account Registration

You are responsible for:

Maintaining account security
Protecting your password
All activity occurring under your account
Keeping account information accurate

You must immediately notify us of any unauthorized use of your account.

We are not responsible for losses caused by unauthorized access resulting from your failure to maintain account security.

5. Subscription Plans and Billing

Certain features may require payment. Subscription plans may include:

Monthly subscriptions
Annual subscriptions
Founder subscriptions
Commercial subscriptions
Enterprise subscriptions

All fees are billed in U.S. Dollars unless otherwise specified.

Subscription fees are non-refundable except where required by law or expressly stated in a separate refund policy.

Failure to pay applicable fees may result in suspension or termination of access to paid features.

We may change pricing at any time upon reasonable notice.

6. Ownership of User Content

6.1 Your Content

You retain all ownership rights to:

Stories, manuscripts, and books
Chapters and notes
Character profiles and locations
World-building content
Images, metadata, and prompts
Exports and other content you create or upload

("User Content") Nothing in these Terms transfers ownership of your User Content to AI Skunkworks, LLC.

6.2 Limited License to Operate the Service

You grant AI Skunkworks, LLC a limited, non-exclusive, revocable license to store, process, transmit, backup, and display User Content solely for the purpose of operating the Service. This license ends when your content is permanently removed from our systems.

6.3 No Claim to Your Books

AI Skunkworks, LLC does not claim ownership of your books, manuscripts, stories, characters, worlds, or intellectual property. You remain solely responsible for protecting and registering your copyrights.

7. AI Generated Content

Dizire Novel Engine may provide AI-generated content including text, suggestions, character descriptions, story ideas, plot outlines, summaries, dialogue, metadata, and other generated materials.

AI-generated content may contain inaccuracies, be incomplete, be unoriginal, or be similar to content generated for other users.

You are solely responsible for reviewing, editing, verifying, and publishing AI-generated content. To the maximum extent permitted by law, AI-generated content produced specifically for your account belongs to you.

8. AI Training

Unless explicitly stated otherwise or unless you opt in through a separate agreement, AI Skunkworks, LLC will not use your manuscripts, stories, books, character information, or other User Content for training proprietary AI models.

Anonymous operational metrics may be collected to improve platform functionality and security.

9. Acceptable Use

You agree not to:

Violate any law
Infringe intellectual property rights
Distribute malware
Attempt unauthorized access
Interfere with Service operations
Abuse APIs
Reverse engineer the platform
Harvest data from other users
Conduct denial-of-service attacks
Circumvent subscription limits

You remain solely responsible for all content created, uploaded, stored, or published through the Service.

10. Copyright and DMCA

We respect intellectual property rights. If you believe content hosted through Dizire Novel Engine infringes your copyright, submit a written DMCA notice containing:

Your contact information
Description of the copyrighted work
Description of the allegedly infringing content
Good-faith statement
Statement under penalty of perjury
Physical or electronic signature

We reserve the right to remove allegedly infringing material.

11. Content Responsibility

You are solely responsible for content you create, upload, and publish, as well as compliance with laws applicable to your work. We do not review all content and do not guarantee legal compliance of any User Content.

12. Adult Content

Dizire Novel Engine may be used to create fictional content intended for adult audiences. All content created through the Service must comply with applicable laws. Users may not use the Service to create, distribute, or promote illegal content.

Any depiction involving minors in sexual contexts is strictly prohibited and may result in immediate account termination and reporting to appropriate authorities.

13. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. Maintenance, upgrades, outages, security incidents, or third-party failures may affect availability. We reserve the right to modify or discontinue features at any time.

14. Data Storage and Backups

We may perform routine backups. However, you remain responsible for maintaining copies of your manuscripts and content. We are not responsible for loss of data resulting from user actions, system failures, third-party failures, or force majeure events. Regular exports are strongly recommended.

15. Account Suspension and Termination

We may suspend or terminate accounts for:

Violation of these Terms
Fraudulent activity
Abuse of the Service
Security concerns
Non-payment

Upon termination, access to the Service may be removed immediately.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI SKUNKWORKS, LLC DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI SKUNKWORKS, LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO AI SKUNKWORKS, LLC DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

18. Indemnification

You agree to defend, indemnify, and hold harmless AI Skunkworks, LLC and its officers, directors, employees, contractors, and affiliates from claims arising from your use of the Service, your User Content, violation of these Terms, or violation of applicable law.

19. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

20. Changes to Terms

We may update these Terms periodically. Updated Terms become effective upon publication. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

21. Governing Law

These Terms shall be governed by the laws of the State of Washington, United States, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Clark County, Washington. You consent to the jurisdiction of those courts.
